Slightly easier for victims of domestic violence
The last government made it much harder to get Legal Aid in family proceedings. Although it said it would continue to protect victims of domestic violence and children, in practice it placed serious barriers in their way. For example, victims of domestic violence had to produce specified evidence of their abuse which had to be no more than two years’ old.
In February this year, the Court of Appeal held that the ‘two year rule’ was unlawful and had to be changed.
This has happened. From today new regulations are in force which extend the relevant period to five years.
